Naa Mart may introduce, change, expand or discontinue features as the platform develops.
3. Eligibility
You should be at least 18 years of age and legally capable of entering into an agreement to independently use services involving membership, transactions or commercial commitments.
If you are acting on behalf of a company, partnership, FPO, organisation or other business, you represent that you have authority to act on behalf of that organisation.
4. Farmer Information and Responsibility
The relevance of agricultural guidance depends substantially on the accuracy and completeness of the information available.
You are responsible for providing reasonably accurate information concerning matters such as:
- Crop
- Variety, where relevant
- Sowing or plantation date
- Crop stage
- Location
- Soil conditions
- Water availability
- Pest or disease symptoms
- Previous treatments
- Farming practices
- Products already applied
- Other relevant field conditions
Incomplete or inaccurate information may affect the usefulness of any guidance provided.
Users should inform Naa Mart or the relevant advisor if circumstances materially change.
5. Agricultural Advisory Disclaimer
Agriculture is inherently affected by factors outside Naa Mart’s control, including:
- Weather
- Rainfall
- Temperature
- Soil conditions
- Water quality and availability
- Crop variety
- Seed quality
- Pest and disease pressure
- Farming practices
- Timing of agricultural operations
- Product quality
- Market conditions
- Natural events
Accordingly, agricultural information or recommendations provided through Naa Mart are intended to support decision-making and do not constitute a guarantee of crop performance, yield, income, harvest quality, pest control, profitability or other agricultural outcome.
Guidance may be based on information supplied by the farmer, crop-stage information, available agricultural knowledge, advisor experience and other relevant sources.
Farmers remain responsible for considering their own field conditions and making final farming decisions.
Where a regulated agricultural product is used, users should follow the manufacturer’s approved label, usage instructions, safety requirements and applicable regulatory guidance.
6. No Guaranteed Outcome
Naa Mart does not guarantee:
- A particular crop yield
- A particular harvest
- A particular increase in income
- A specific market price
- Availability of a buyer
- Sale of produce
- Availability of a particular product
- Suitability of every product for every farm
- Availability of a particular service provider
- Approval of a partner application
- Continuous availability of platform services
Statements concerning possible benefits, opportunities or expected results should not be interpreted as guarantees.
7. Products and Services from Third Parties
Products and services displayed, recommended, introduced or discovered through Naa Mart may be supplied by independent agricultural businesses such as:
- Manufacturers
- Dealers
- Distributors
- FPOs
- Service providers
- Logistics providers
- Buyers
- Other ecosystem partners
Unless expressly stated otherwise, such third parties remain responsible for the products or services they supply.
Product descriptions, specifications, warranties, availability and usage instructions may originate from the relevant manufacturer, seller or service provider.
Naa Mart seeks to work with appropriate ecosystem participants but does not independently manufacture every product or perform every service made discoverable through the platform.
8. Partner and Seller Responsibility
Partners participating in the Naa Mart ecosystem are responsible for ensuring that information supplied by them is accurate and that their business activities comply with applicable law.
Partners must not knowingly provide:
- False product information
- Misleading claims
- Counterfeit products
- Expired products
- Prohibited products
- Incorrect pricing information
- False business credentials
- Misleading service descriptions
Naa Mart may suspend, restrict or remove access to partners where there are reasonable concerns regarding misuse, inaccurate information, customer safety, fraud or non-compliance.
9. Product Availability
A product, service or partner appearing through Naa Mart does not necessarily mean that it is currently available in every location.
Availability may depend on:
- Geography
- Inventory
- Season
- Dealer availability
- Partner capacity
- Delivery feasibility
- Regulatory restrictions
- Farmer requirements
Where an enquiry or availability-confirmation process is used, an order should not be considered confirmed until the relevant confirmation has been communicated.
10. Prices
Where prices are displayed, they may be subject to applicable taxes, delivery charges or other charges disclosed before completion of the relevant transaction.
Prices may change over time.
For transactions involving independent partners, the applicable seller or service provider may determine the final price, subject to the terms presented for that transaction and applicable law.
Naa Mart will seek to disclose relevant charges before a user becomes contractually committed to a transaction.
11. Orders
Where ordering functionality is available, submission of an order request does not necessarily mean that the order has been accepted.
An order may be subject to:
- Product availability
- Seller confirmation
- Serviceability
- Payment confirmation
- Compliance checks
- Quantity limitations
- Other reasonable transaction requirements
Users should review transaction details before confirming an order.
12. Payments
Where online payment functionality is available, payments may be processed by third-party payment service providers.
Depending on the transaction, payment may be collected:
- By NACRO MART INDIA PRIVATE LIMITED
- Directly by a participating seller or partner
- Through an authorised payment service provider
The identity of the relevant collecting party should be communicated as part of the transaction where applicable.
A payment should not be treated as finally confirmed solely because a browser or application displays a successful screen. Payment status may depend on verification from the applicable payment provider.
Naa Mart may maintain transaction references and payment status for reconciliation and support purposes.
13. Cancellations, Refunds and Returns
Cancellation, return and refund rights may vary depending on:
- The type of product or service
- Whether the transaction is with Naa Mart or an independent partner
- Whether a service has already been performed
- Product condition
- Applicable seller policies
- Applicable law
The relevant cancellation or refund conditions should be disclosed in connection with the applicable transaction where required.
Nothing in these Terms is intended to remove any mandatory consumer right available under applicable law.
14. Memberships
Naa Mart may offer farmer, partner or other memberships.
The applicable:
- Membership fee
- Duration
- Benefits
- Renewal conditions
- Trial terms
- Cancellation terms
- Refund conditions
will be communicated through the relevant membership offer or enrolment process.
Membership benefits may depend on geography, service availability and platform capability.
Unless explicitly stated otherwise, membership does not guarantee agricultural results, financial returns, product availability, buyer availability or sales.
15. Market and Buyer Connections
Naa Mart may help farmers discover or connect with potential buyers or market participants.
Such introductions do not guarantee:
- That a buyer will purchase produce
- A particular purchase quantity
- A particular price
- A particular date of purchase
- Acceptance of produce quality
- Completion of a commercial transaction
Unless Naa Mart expressly enters into the relevant purchase contract itself, commercial terms between a farmer and an independent buyer remain the responsibility of those parties.
16. Partner Applications
Submitting a Partner enquiry or registration does not automatically make an organisation or person an approved Naa Mart Mitra or authorised Naa Mart partner.
Naa Mart may conduct qualification, documentation, commercial, compliance or other checks before approving a partner.
Naa Mart may approve, reject, suspend or discontinue a partner relationship in accordance with its operating requirements and applicable agreements.
17. Communication
Where you submit an enquiry, you authorise Naa Mart to contact you regarding that enquiry using the contact details you provide.
WhatsApp communication will be governed by the preference or consent you provide where a WhatsApp consent option is presented.
Users may request changes to optional communication preferences.
Our handling of personal information is also governed by our Privacy Policy.
18. User Conduct
You must not use Naa Mart to:
- Provide deliberately false information
- Impersonate another person
- Commit fraud
- Interfere with the operation of the platform
- Attempt unauthorised access to systems or records
- Upload malicious software
- Harass advisors, partners or other users
- Infringe intellectual-property rights
- Promote unlawful products or activities
- Submit misleading partner or business information
- Use platform information for unauthorised scraping, resale or exploitation
Naa Mart may restrict access where reasonably necessary to protect users, partners, systems or the business.
19. User-Provided Content
Where you submit photographs, documents, crop information, questions, reviews or other content, you retain any rights that you legally hold in that content.
You permit Naa Mart to use such content to the extent reasonably necessary to:
- Respond to your request
- Provide advisory services
- Maintain service records
- Facilitate requested interactions
- Operate the platform
Naa Mart will handle personal information contained in such content in accordance with its Privacy Policy.
You should not upload material that you do not have the right to provide.
20. Intellectual Property
Unless otherwise stated, the Naa Mart platform and its original content, including applicable:
- Branding
- Logos
- Website design
- Written material
- Platform functionality
- Software
- Databases
- Workflows
- Visual content
- Proprietary advisory materials
are owned by or licensed to NACRO MART INDIA PRIVATE LIMITED.
Use of the website does not transfer ownership of these rights to the user.
Content may not be copied, commercially reproduced, distributed or exploited without appropriate permission, except where permitted by law.
Third-party names, trademarks and content remain the property of their respective owners.
21. Third-Party Websites and Services
Naa Mart may provide links or connections to third-party websites, payment services, WhatsApp, social-media platforms or external service providers.
Those services may be subject to separate terms and privacy policies.
Naa Mart is not responsible for the independent operation, content or data practices of third-party platforms that it does not control.
22. Platform Availability
Naa Mart seeks to maintain reliable services but does not guarantee uninterrupted or error-free availability.
Services may occasionally be unavailable due to:
- Maintenance
- Technical failures
- Internet or telecom outages
- Third-party service interruptions
- Security incidents
- Upgrades
- Events outside reasonable control
Naa Mart may modify platform functionality as required for operational, technical, commercial, security or regulatory reasons.
23. Experimental and Developing Features
Naa Mart is an evolving platform.
Certain features may initially be:
- Pilot services
- Limited to specific regions
- Manually operated
- Available only to selected users
- Modified based on operational learning
The availability of a pilot feature should not be interpreted as a commitment that the feature will remain permanently available in the same form.
24. Automated and AI-Assisted Features
Naa Mart may in future use software, automation or artificial intelligence to support functions such as:
- Organising information
- Retrieving relevant knowledge
- Preparing draft responses
- Summarising interactions
- Identifying potentially relevant information
- Supporting advisors
Where such tools are used, their outputs may be subject to review and should not be treated as infallible.
Important agricultural decisions should be considered in light of actual field conditions and, where appropriate, reviewed with a qualified human advisor.
Naa Mart does not represent that automated systems will always produce complete or error-free outputs.
25. Limitation of Liability
To the fullest extent permitted by applicable law, NACRO MART INDIA PRIVATE LIMITED will not be responsible for indirect, incidental or consequential losses arising solely from reliance on general information made available through the platform.
In particular, because agricultural outcomes depend on numerous circumstances outside Naa Mart’s control, Naa Mart does not assume liability merely because an expected agricultural, market or financial outcome does not occur.
Nothing in these Terms:
- Excludes liability that cannot legally be excluded
- Restricts statutory consumer rights
- Excuses fraud or wilful misconduct
- Overrides obligations imposed by applicable law
Where liability relates to a product or service supplied independently by a third-party partner, responsibility may also rest with the relevant manufacturer, seller or service provider according to applicable law and the circumstances of the transaction.
